The Violence Against Women Act (VAWA) provides a pathway for certain individuals to apply for immigration status independently, without relying on an abusive family member. This protection is available to survivors who have experienced abuse from a U.S. citizen or lawful permanent resident.

These cases are highly sensitive and require a careful, respectful, and strategic approach.

Who may qualify

VAWA may apply to individuals who have been abused by:

  • A U.S. citizen or lawful permanent resident spouse

  • A parent

  • An adult child

Eligibility is not limited to physical abuse. Emotional, psychological, and financial abuse may also be considered.

What the process involves

VAWA petitions require:

  • A clear demonstration of the relationship

  • Evidence of abuse

  • Proof of good moral character

  • Documentation showing residence with the abuser
